rental rules: BOOKING & OCCUPANCY TERMS & CONDITIONS
Section A: Conditions of Use of the Property
1. Sub-letting the Property to any third party is strictly forbidden and will result in the cancellation of the booking and subsequent expulsion of the occupants.
2. As the Property is within a secure estate, access and use of the rented Property and the common use areas, including the various leisure facilities, is restricted to Clients as detailed in the original booking. No access to day visitors or invitees of Clients shall be allowed unless prior authorization, in writing, has been obtained.
3. No items belonging to the Property may be removed from the Property or its exclusive use area.
4. The Property is rented on a strict “Non-Smoking” basis. Any Client or occupant found in breach of this condition shall be forced to vacate the Property and be liable for all costs associated with restoring the Property to a non-smoking status – including but not limited to sanitizing and dry cleaning of curtains and all fabric covered furnishings.
5. Clients with young children are advised not to leave them unattended on the terrace, garden or pool area.
6. A safe is provided in the bedroom. It is advisable to lock any valuables in the safe and to close and lock all doors and windows when leaving the Property. The Host shall not be responsible or held liable for any theft of a Client’s personal belongings, or of items belonging to the Property, irrespective of the circumstances resulting in the theft. Any incident involving theft is to be reported to VMA Security immediately.
7. The Property has a Webber gas BBQ on the terrace. Please ensure that the gas is turned off after use. In the unlikely event that the gas runs out kindly contact The Housekeeper to arrange a replacement cylinder. We will not be responsible for any inconvenience caused by a shortage of gas supply or the replacement thereof nor for any damage, loss or injury caused by the Client’s use of the BBQ.
8. An EPV, with a seating capacity of 4, is provided and included in the rental rate of the Property, and strictly subject to the EPV Use Rules detailed below in the relevant section.
9. Due to the high humidity in the Seychelles, Clients are requested from refraining using the air conditioning systems whilst windows and/or doors are open in the Property. Please do not leave air conditioning units on when not in the Property.
10. All refuse is to be placed in the appropriate refuse bins located in the dedicated areas of the Property.
11. Swimming or fishing in the basins or waterways is strictly forbidden.
12. Occupancy and use of the Property is subject to adherence to the House Rules and rules of the Eden Island VMA, the most pertinent of which are included in these Terms & Conditions. A copy of the full VMA Rules can be requested.
13. The Client is requested to notify The Housekeeper of any damage to, malfunction of or loss of any item and/or equipment belonging to the Property.
Section B: Property Maintenance & Disruption of Services
1. The Host will utilize his best efforts to ensure that all equipment and items in the Property are functional. Occasionally emergency, remedial or preventative maintenance is undertaken and whilst all efforts will be made to avoid inconvenience The Host shall not be held responsible or liable for any disruption or inconvenience that any of these services may have on a Client.
2. Any appliance or item of equipment that is found not to be functional must be reported to The Host and/or The Housekeeper, who will endeavor to have it repaired and/or replaced as quickly as possible.
3. The Host shall however not be responsible or liable for any item of equipment and/or appliance that is not functional, nor for any inconvenience caused as a result thereof.
4. Whilst every effort will be made by The Host, Clients are advised that due to the general limited availability of spares and/or service staff in the Seychelles, there is no guarantee that any appliances or equipment requiring repair or replacement will be undertaken in a generally acceptable time frame.
5. The Host shall not be responsible or liable for any disruptions to service, such as water, electricity, satellite TV or internet, which may affect the stay of a Client.
6. The Client is requested to notify The Host and/or The Housekeeper of any damage to, malfunction of or loss of any item and/or equipment belonging to the Property.
Section C: Use of EPV (Electrically Powered Vehicle)
EPV’s are to be treated as normal vehicles. The right of use thereof is conditional on inter alia the following rules:
1. Seating capacity is limited to the number of seats (4). Overloading of the EPV is strictly forbidden.
2. Seychelles road rules are to keep left, despite EPV’s being left hand drive. Take caution not to veer off to the right hand side of the road, thereby potentially causing an accident with an oncoming EPV. Traffic circles are to be used in a clock wise direction giving way to traffic approaching from the right.
3. Please be aware of pedestrians, particularly children, who also make use of EPV roads.
4. Please do not drive or park on the lawns or on the beaches.
5. Driving of an EPV is strictly limited to persons over the age of 18 and who hold a valid driver’s license.
6. Take care when using the rain covers as if not properly secured, these can flap and either injure pedestrians or catch on trees and/or other passing EPV’s. Damage caused to a rain cover, whether accidental or through negligence, is for the account of the Client.
7. Driving under the influence of alcohol or any intoxicating substance is strictly forbidden.
8. Always use extreme caution and common sense when driving an EPV.
9. Failure to comply with the above rules may lead to a fine being imposed by the VMA and/or confiscation of the EPV.
10. Damage caused to the EPV or its equipment shall be the sole responsibility of the Client, irrespective of the circumstances which may have caused the damage.
11. In the event of any mechanical failure, damage or accident, Clients are requested to notify The Host and/or The Housekeeper immediately.
12. In the event of an accident, please report immediately to the VMA Call Centre located at the entrance to the estate as well as notify The Host and/or The Housekeeper. In such cases, Clients are responsible for repairs to damage caused to their EPV, irrespective of the party responsible for the cause of an accident.
13. The Host shall not be responsible or liable for any damage to an EPV, injury to and/or death of a passenger and/or to/of a third party, caused by an accident, irrespective of the circumstances.
Section D: Security, Breakages & Damages Deposit
1. Except in the case of normal wear and tear, the Client shall be responsible for any damage, breakages or loss caused to the Property or its contents, whether such damage, breakages or loss was caused accidentally, through negligence, willful default or irresponsible behavior on the part of the Client and/or any of the guests occupying the property.
2. The Host will inspect the property following departure of the Client and in the event of any damage, breakages or loss, shall communicate this to the Client, in writing, within 7 days of departure.
3. Where damage, breakages or loss have been found, the replacement and/or repair value thereof will be charged and payable by the Client.
4. Loss of the keys and/or of the EPV key will result in a charge of $ 50.00 being charged to the Client.
Section E: Limitation of Liability
1. The Host shall not be responsible or held liable for any incident that results in personal injury, death, loss of or damage to any property of any Client or person occupying or visiting the property or through the use of any of the facilities at Eden Island.
2. Use of the property or any of the facilities, including but not limited to beaches, swimming pools, gymnasium, boardwalks, jetties, walkways, EPV roads or any other facility on the island is done entirely at the Client’s risk and the Client hereby indemnifies The Host from any claims arising therefrom.
3. All vehicles parked on Eden Island are done so at the risk of the Client.
4. In the event of any emergency and/or accident, Clients are requested to immediately notify the VMA as well as The Host.
5. Clients are strongly advised to take out appropriate Travel Insurance.
